Parking Expiation Notices

 

Parking restrictions and expiations are defined by the Australian Road Rules (ARR) and South Australian Road Traffic Act 1961.

Council Officers have delegated authority under the Local Government Act to enforce legislation within the Copper Coast, including the issuing of parking expiation notices.
 

 

Who is Responsible for Paying an Expiation Notice?

 

When a vehicle is found to break a traffic offence, the owner of the motor vehicle is responsible for the Expiation Notice.

If the owner of the motor vehicle was not driving at the time the Expiation Notice was issued, the owner is required to provide a signed Statutory Declaration advising the responsible persons full name and address.

In the event that the motor vehicle has been sold or disposed of prior to the offence date, the owner is required to forward to Council a copy of the disposal notice or a Statutory Declaration with the new owner's full name and address.

 

Payment of Expiation Notices

 

Copper Coast Council offers a number of ways for you to pay your parking fine.

  • By telephone. Call the Council office between 9.00am - 5.00pm Monday-Friday on (08) 88281 200. Ensure you have the expiation notice and your credit card available at the time of the call.
  • In person. Please present your expiation notice to the Kadina office. Payment can be by cash. cheque, debit card or credit card.
  • By mail. Cheques or money orders should be made payable to Copper Coast Council and forwarded with the expiation notice details to PO Box 396, Kadina SA 5554.

Please be advised that receipts will only be issued if clearly requested. 

 

Outstanding Expiation Notices

 

Payment of an Expiation Notice is required within twenty-eight (28) days.

Expiation Notice - Reminder Notice

Failure to pay the Expiation Notice by the due date will result in the registered vehicle owner being issued with a Reminder Notice.  The Reminder Notice will incur the following additional charges:

  • A late fee
  • A motor vehicle search fee

The Reminder Notice will require payment within fourteen (14) days.

If payment is not made by the due date, the Expiation Notice will be forwarded to the Fines Enforcement and Recovery Unit for enforcement. Once this happens, Council will not longer be able to assist the individual in regard to the expiation.

Expiation Notice - Enforcement

Council In 2014 the Attorney-General's Department implemented the Fines Enforcement and Recovery Unit (FERU) for the recovery and enforcement of overdue debts owed on expiation notices issued by Issuing Authorities (eg Council).

FERU offer various options to assist people with managing with the intent to pay outstanding expiation notices.

Payment can be made by:

  • Online
  • over the phone
  • Via post
  • In person
Payment types include:
  • Credit card
  • Bpay
  • Cash and EFTPOS
  • Cheque/money order
  • Direct Debit
  • CentrePay.

Payment Arrangements can be requested and a fee may apply.

Fines Enforcement and Recovery Unit (FERU) - Enforcement Actions

For those who evade paying their fines, FERU will take enforcement actions to recover the amounts owed. Additional enforcement fees will be added, including:

  • Interest
  • and any other enforcement costs
Expiation Notices do not result in demerit points against your driver's licence. However, if the matter proceeds to FERU there may be other consequences if not paid. Enforcements actions under the Fines Enforcement and Debt Recovery Act 2017 include:
  • Restriction on transacting business with the Registrar of Motor Vehicles
  • Suspension of driver’s licence
  • Clamping and impounding of a vehicle
  • Garnishment (automatic payments from a person's salary or bank account)
  • Seizure and sale of property
  • Publication of names
